Short-Term Rental Agreement

This Rental Agreement (“Agreement”) is between the owner of The Milford Opera House, 339 N Main Street, Milford, MI 48381 (the “Property”) and the guest who submits a booking request (the “Guest”). Submitting a request and checking the acceptance box constitutes the Guest’s electronic signature and agreement to these terms.
1. The stay
- Check-in: from 3:00 PM on the arrival date (arrival window 3:00–10:00 PM; early check-in is not available). Check-out: by 11:00 AM on the departure date.
- Self check-in by keypad code, provided by email two days before arrival.
- The premises are the private upper-floor residence of the Opera House building only.
- Safety: smoke and carbon monoxide alarms are installed. The loft sits directly above Main Street businesses, and noise carries in both directions.
2. Occupancy and conduct
- Maximum occupancy: 6 guests total. Only registered guests may stay overnight.
- The Guest submitting the booking must be 21 years of age or older and present during the stay.
- No smoking anywhere on the premises. No parties or events. No loud music before 7:00 PM — the loft sits directly above Main Street businesses and sound carries; do not throw anything (including cigarette butts) from the deck.
- Do not move the furniture (it scratches the floors) or set drinks on the pool table.
- No pets unless approved by the owner in writing before arrival.
3. Payment schedule
- Nothing is charged when a request is submitted. On the owner’s approval, a deposit equal to one night (plus tax) is charged to the card on file.
- The remaining balance is charged automatically 28 days before check-in (or together with the deposit if check-in is within 28 days).
- All amounts include 6% Michigan use tax. There are no cleaning or service fees.
4. Cancellation
- 30 or more days before check-in: full refund of all amounts paid.
- More than 7 and fewer than 30 days before check-in: 50% of amounts paid are refunded.
- 7 days or fewer before check-in: no refund.
- Grace period: a booking cancelled within 48 hours of the deposit charge is fully refunded, as long as check-in is more than 7 days away.
- When cancelled dates re-book, the earlier guest is automatically refunded up to what the re-booking recovered — so a retained amount may still come back to you if the dates fill.
5. If the owner cancels, or the stay is disrupted
- Owner cancellation: if the owner cancels a confirmed booking for any reason, the Guest receives a full refund of all amounts paid. The owner will give as much notice as possible and help identify alternatives where they can. The refund of all amounts paid is the Guest’s sole and exclusive remedy for an owner cancellation.
- Extenuating circumstances: if an event outside either party’s control — a natural disaster, government order, utility failure, or similar — makes it unsafe, impractical, or unlawful to complete the stay, the owner will refund amounts paid for the nights that cannot be honored. Neither party is liable to the other for further damages in that case.
- Problems on arrival: if there is a serious problem with the Property at check-in that the owner cannot promptly resolve, the Guest should notify the owner within 24 hours. Remedies may include fixing the issue, a partial refund, or cancellation with a full refund, depending on the circumstances.
6. Damage
- The Guest is responsible for damage beyond normal wear and tear, for missing items, and for cleaning beyond what an ordinary stay requires, and agrees to reimburse the owner for documented repair or replacement.
- If something is damaged, tell the owner. He will raise it with the Guest directly, and the two will agree how to put it right.
- Please do not set drinks on the pool table. The cloth is original to the building and a replacement runs about $600, which is the kind of cost the clause above refers to.
7. Liability
- The Guest accepts the Property as-is, including the character of a historic 1875 building (stairs, original features).
- The owner is not liable for the Guest’s personal property or for injuries arising from misuse of the premises, to the extent permitted by Michigan law.
8. Miscellaneous
- The site’s availability calendar and the owner’s booking records are the record of the reservation. Payments are processed by Stripe; card numbers never touch the site’s servers.
- This Agreement is governed by Michigan law. Venue for any dispute is Oakland County, Michigan.
